Under current tax code, through the use of an
insurance contract, an employer is permitted to selectively cover
(or, in other words, discriminate in favor of) certain of its executives
and/or key employees with a plan providing reimbursement of out-of-pocket
medical, dental, and vision expenses on a tax-free basis. The insurance
contract that our firm uses for this purpose is known as 'Exec-U-Care'.
In addition to providing reimbursement insurance
through Jefferson Pilot Financial Insurance Company Benefit Partners
(JPF Benefit Partners), Exec-U-Care also provides each executive with
an additional $100,000 of accidental death & dismemberment insurance
and a unique service called "MEDEX
Worldwide Medical Assistance". The fixed fees of this program
are $62.50 per quarter per executive, and 110% of total eligible
medical reimbursement claims.
The typical kinds of unreimbursed expenses which
may be submitted for reimbursement are any health care expenses
that would be deductible under IRS Code Section 213(d) (ignoring
for this purpose the deduction threshold found under that Code
Section). The
"covered expenses" are the same as the qualified medical
expenses under either HSAs or Health Care Reimbursement accounts
under Flexible Spending Account (FSA) arrangements.
